Dershowitz: on the left’s lawfare against Trump’s lawyers — 12 Comments

  1. Nice article Neo.

I like the lawyers insisting on a speedy trial, a great tactical decision that will necessarily bring about a severing of the prosecutions.

What I am a bit confused about is this notion that Trump’s lawyers are being attacked and that they are helplessly flailing under the assault.

Lawyers are not babes in the woods. They write and enforce our laws through lawsuits. They can bring their own cases to court without requiring a retainer like I must.

FYI, your introductory paragraph uses the word ‘adversary’ when it should read ‘adversarial’. Sorry to be pedantic, but our currency is words.

  2. well look at one happened to eastman*, who was one of the leading constitutionalist, look at the garbage guiliani has faced, or peter navarro,

*eastman, pointed out to laura, the intent was to present the evidence of fraud, (which has become more self evident as time goes on)

if you stand for the rule of law, you’re under attack,

  3. You said “The judges and juries are so biased that they will convict despite the weakness of the cases. Any appeals will only occur after the election, and so even if reversals occur they will come too late to help Trump in time for the 2024 voting.”

Of course, the same could be said of legal challenges to the 2020 vote. And that is precisely the problem with a politicized, activist judiciary.

  4. The right must treat these attacks like the attack on Pearl Harbor and respond with total lawfare against the left. If Republican AGs and DAs won’t do it they will be swept aside by those who will and the rest of us if we are on Grand Juries or trial juries need to indict or convict regardless of if the target is large or small. No mercy for minions.

The first people to go after are the anti-gun groups AND their lawyers. They are nothing but a criminal conspiracy against rights anyway.

  5. The Left is determined to have its totalitarian governance and will reap its natural consequence.

  6. This is an extension of the recent tactic of bleed the victim dry financially.

The victim loses even though never convicted, and a clear message is sent to others; “If you act so as get within our sights you will lose one way or the other”.

It goes without saying that it is an effective way to isolate the true target by scaring away any potential allies or supporters.

Which brings up another thought. Some still say that this will go too far some day and there will be a popular uprising. I have come to doubt that because any potential leaders of such actions have been isolated by a variety of tactics, including infiltration of their families or groups by secret
    police.

One final thought while I am at it. I have heard ad nauseam that while the FBI is rotten at the top, the rank and file are good people. Oh? News this week of a massive FBI raid on the home of a disabled veteran using tear gas, flash grenades, etc.; after his mother, who answered the early morning banging on the door, was dragged from the house. He was killed. So, who are these “agents”? Do any of the rank and file ever ask, “what the hell are we doing? How hard is it to take a solitary individual into custody, without violence, in a setting of our choosing, rather than launching a commando raid on a home?” Apparently not.
Of course the justification for the subsequent killing is usually, “the target may have been armed”. Well, who wouldn’t be when their home is invaded in the predawn hours? Or should an individual startled out of sleep assume that the screaming intruders are law enforcement; rather than home invaders of a different stripe?
Too many in Federal law enforcement seem to have watched too much television, where such tactics are endemic and systemic–to steal a phrase.

  7. I have heard ad nauseam that while the FBI is rotten at the top, the rank and file are good people. Oh?

    Oldflyer:

    Agreed.

I don’t know that the rank and file of the FBI, as well as those of law enforcement and the military in general, are “bad people.”

But I’m not betting that the rank and file of those in uniform will buck the system against obvious, gross, totalitarian crackdowns on the Right.

This leftist never forgot the cynical Civil Rights aphorism:

  8. not_a_lawyer:

These lawyers are being attacked in novel ways, and in venues in which they are guilty till proven innocent. As Dershowitz says, this is something new and it has a chilling effect on the defense of Trump and others on the right. Lawyering for the right is being criminalized by the left.

  9. More of Dershowitz criticizing from the side lines. If he really cared he would offer his services to Trump and supporters. That won’t happen because he is a died in the wool Leftist and a Never Trump. He would watch the legal system be destroyed if it meant taking down Trump.

He’s 85 years old. Give it a rest.

  11. Chases Eagles says: “The right must treat these attacks like the attack on Pearl Harbor and respond with total lawfare against the left.”

Respectfully disagree in part. Agree with the Pearl Harbor part. Disagree with the lawfare part.

The left doesn’t want rules anymore. Given that, if there are no rules, there are no rules and ANYTHING is open to Our Side. Time to go for it. With gusto. Cheers –
