Jonathan Turley points out…. — 21 Comments

  1. Eugene Debs ran for President from Prison. Didn’t win though. To many people just do not understand the Constitution. But then so many Dems really want to tear it up anyway. Someday that same Constitution may save them.

  2. Turley is wrong. The deep state will make sure Trump is charged with a felony which will make him ineligible to run for any office or even to vote in any elections.

I’m not 100% sure but they may not even have to convict him as long as they charge him before the elections and just ensure he doesn’t get the charges dropped.

  3. Being charged with a felony, or even being convicted of one, is not mentioned in the Constitution as disqualifying a person to be elected president. The only mention of crimes is with reference to impeachment and removal. People might decide, as a matter of judgment as voters, not to vote for an accused or convicted felon, but it’s not a constitutional requirement.

All J6 defendants should be pardoned if they committed no violence. If violent, their sentences should be commuted consistent with penalties accorded to 2017 inaugural rioters or to 2020 rioters in Lafayette Square.

  4. The “inflammatory rhetoric” notwithstanding (and who, exactly, would not be annoyed and enraged after eight years, since his descent of the escalator in 2015, of endless persecution and malicious, mendacious, and scurrilous accusations of no substance?), Trump (despite his age, there certainly being sound arguments against a gerontocracy, and despite his many foibles and his missteps as POTUS) is in a better position to lead a movement for the renewal of our beleaguered republic than even DeSantis, the favorite of GOPe and of the Murdochs and of the big-money donors and guilty, recently, of the most ludicrous flip-flopping on the topic of our insane policy in Ukraine.

  5. “The deep state will make sure Trump is charged with a felony which will make him ineligible”

No. Look at Article II of the Constitution, which is the sole arbiter of eligibility. Here are the terms and conditions

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Notice the lack of “conviction” and “felony”. This is precisely why the Usual Suspects want to elevate the J6 affray as an “insurrection” so they could invoke the 14th amendment, section 3.

  6. While we’re speculating… What if in his last week in office he’d simply pardoned the J6 political prisoners?

That’s not merely a hypothetical. He could have and should have.

  7. Kris:

Yes, but i think most people assume it’s the J6 case that is the strongest, or the documents case, and I think both are federal.

  8. Trump without the ability to hold rallies and campaign would be a much-diminished force.

  9. passion fruit maybe, the law breakers are free, and the law abiding are under threat,

  10. Turley is wrong. The deep state will make sure Trump is charged with a felony which will make him ineligible to run for any office or even to vote in any elections.
    ==
State court charges do not compromise his franchise to run for a federal office. He’s not running for office in New York or Georgia. He can only be disqualified for federal office by a specific legislative act subsequent to impeachment proceedings.

  11. of our insane policy in Ukraine.
    ==
Our policy is not insane or even troublesome.

  12. Bauxite:

That’s why I said you have gone full banana. Banana republic Bauxite, that is how they make opposition illegal.

Do I have to draw a picture?

    Terminal OMB.

  13. Turley – Trump could run from jail and promise to pardon himself.

me – Trump probably wouldn’t win if he ran from jail.

    om – OMB!

Somebody has Trump-related derangement. It’s not (just?) me.

  14. Bauxite:

Is the judicial action against political opposition to the Democrat party a good thing or Banana republic stuff? Focus.

Should Harry Logan or Jeb! or Chris Christie be targeted by Democrat lawyers and DAs from the county to the Federal level. Good with that? Focus.

Or is it only The Great Orange Whale that is a threat to your serenity?

  15. Nothing trump was illegal everything biden does is treasonous to our country in small ways as well as large

  16. This is why they stole the election and proscribe those who point it out

  17. Yep, that’s the long and short of it.
And it’s outrageously criminal that those defendants—and their families—have to PAY for it….

  18. You’re being silly om. I was making a comment on Trump’s viability as a candidate if he ends up in prison, not on whether the prosecutions of Trump are justified. I’ve said repeatedly that the Bragg prosecution is ridiculous. I don’t have a very high opinion of the DOJ SC and Georgia investigations either.

But, you be you (to coin a phrase). I recommend a deep breath and a count to ten. 🙂
